PRINCETON — A magistrate ruled Wednesday that the case of a man facing charges including attempted first-degree murder had probable cause and bound it over to the Mercer County Grand Jury.

Timothy Gibbs, 30, now being held at the Southwest Regional Jail in Logan County, had a preliminary hearing before Magistrate Charles Poe. Poe ruled that the case had probable cause, according to court records.

Gibbs was found soon after midnight Jan. 14 when a shooting was reported at Strawberry Loop Road near Princeton. He told investigators with the Mercer County Sheriff’s Department that he was walking from the intersection of Maple Acres Road and Glenwood Park Road when a male individual attempted to rob him, and then shot him when they fought.

First responders transported Gibbs to Princeton Community Hospital, and he was later taken to Charleston Area Medical Center. Agents with the U.S. Marshals Service arrested Gibbs, who was on federal probation, in Welch after the hospital discharged him.

During the investigation, a cellphone belonging to a second person, Amy Mitchem, 20, of Bluefield was searched after a warrant was obtained, according to a criminal complaint filed by Lt. M.T. Hatfield with the Mercer County Sheriff’s Department. Messages showed that Mitchem and Gibbs had “conspired together” to lure a Bluefield man to Strawberry Loop Road and rob him. The intended victim thought that he was going to pick up a bag for Mitchem.

The man, who was located with help from the Bluefield Police Department, said he had a Glock 9-mm pistol with him the morning of Jan. 14, Hatfield stated in the criminal complaint. When he arrived at his destination, he “heard what sounded like a slide of a semi-automatic pistol and was met by gunfire. He stated that he fell back, quickly checked himself for injuries and was able to return fire.” Fearing for his life, he fled the area.

Gibbs is facing charges including first-degree robbery, attempted first-degree murder, six counts of wanton endangerment, and possession of a firearm by a felon. He is being held on a $25,000 cash-only bond.

Mitchem has been charged with “robbery or attempted robbery” and principal in the second degree in relation to a shooting. She is being held at the Southern Regional Jail in Beaver on a $25,000 cash-only bond.
